Drywall Dynamics Inc. alleged to have breached bargaining agreement

LOS ANGELES – Labor groups have filed suit against an employer over allegations it did not pay contributions.

Southwest Regional Council of Carpenters, Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on Feb. 14 in the U.S. District Court for the Central District of California, Western Division against Drywall Dynamics Inc. and Does 1 through 10 alleging damages for failure to pay fringe benefit contributions and other counts.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions. The plaintiffs hold Drywall Dynamics Inc. and Does 1 through 10 responsible because the defendants allegedly breached its bargaining agreement with the plaintiffs by failing to make its monthly contributions on behalf of its employees.

The plaintiffs seek order the defendant to submit to an audit, unpaid contribution plus interest, liquidated damages, cost of audit, all legal fees and any other relief as the court deems just. They are represented by Daniel M. Shanley and Jodi Siegner of DeCarlo & Shanley in Los Angeles.
