Woman alleges disability benefits were wrongfully terminated

SAN FRANCISCO – An Alameda County woman alleges she is disabled because of breast cancer and that her disability benefits were wrongfully terminated.

Cha-Shawn Grogans filed a complaint on Feb. 12 in the U.S. District Court for the Northern District of California against Aetna Life Insurance Co. and Bank of America Long-Term Disability Insurance Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on Oct. 24, 2015, she suffered damages from defendant's discontinuance of her long-term disability benefits. The plaintiff holds Aetna Life Insurance Co. and Bank of America Long-Term Disability Insurance Plan responsible because the defendants allegedly failed to pay disability benefit payments to plaintiff, failed to consider plaintiff's psychological exam report and confirmation from Social Security of plaintiff's disability, and failed to discharge its duties in respect to claims processing in the interests of plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant, declaratory relief, payment of back disability insurance benefits, interest, attorney's fees, costs, and other relief as the court finds appropriate.
