Oakland Pallet Co. Inc. alleged to have not paid overtime wages

OAKLAND – An employee for an Alameda County company alleges he was not given meal and rest breaks or compensated for overtime work.

Francisco Padilla, individually and on behalf of all others similarly situated filed a complaint on Feb. 17 in the U.S. District Court for the Northern District of California against Oakland Pallet Co. Inc., Jose G. Padilla, Carlos Padilla, et al., alleging that they violated the Fair Labor Standards Act and other counts.

According to the complaint, the plaintiff alleges that he performed hourly labor and driving duties for defendants in excess of 40 hours per week without receiving overtime compensation. As a result, plaintiff claims he suffered monetary damages in the form of lost overtime compensation. The plaintiff holds Oakland Pallet Co. Inc., Jose G. Padilla, Carlos Padilla, et al. responsible because the defendants allegedly intentionally disregarded their responsibilities under the FLSA by failing to pay their hourly labor employees for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks award for economic and compensatory damages, plus liquidated damages, restitution of all unpaid meal and rest break premiums, attorney's fees and costs and such other appropriate relief.
