ColossalCon alleges Colossus Con name infringes trademark

SAN FRANCISCO – An Ohio limited liability company that operates pop culture conventions claim its trademark is being unlawfully used for another convention.

Nostalgiaconventions.com LLC, doing business as ColossalCon, filed a complaint on Feb. 10 in the U.S. District Court for the Northern District of California against the Colossus Con, also known as Colossus Pop Culture Expo & Comic Con and Colossus Pop Expo; Marina Lukyantseva, also known as Marina Lukyantseva-Haworth; Davidson Haworth; and Does 1 through 10, alleging trademark infringement, unfair competition, false advertising and other counts.

According to the complaint, the plaintiff alleges that it owns the registered trademark ColossalCon for use in pop culture conventions since 2002. The plaintiff holds Colossus Con, also known as Colossus Pop Culture Expo & Comic Con and Colossus Pop Expo; Marina Lukyantseva, also known as Marina Lukyantseva-Haworth; Davidson Haworth, and Does 1 through 10 responsible because the defendants allegedly used the similar mark Colossus Con for conventions to profit from the goodwill associated with the plaintiff and to deceive consumers.

The plaintiff requests a trial by jury and seeks payment of damages plus profits, statutory damages of $100,000 per infringing domain name, $200,000 per counterfeited mark, all legal fees, interest and any other relief as the court deems just.
