Copyright 03

LOS ANGELES – A Los Angeles company alleges its textile design was used without its permission for garments.

Jitrade Inc. filed a complaint on Feb. 22 in the U.S. District Court for the Central District of California against the Calysta Apparel Inc., doing business as Sway Apparel, and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its SND1607_9A fabric design copied. The plaintiff holds Calysta Apparel Inc., doing business as Sway Apparel, and Does 1-10 responsible because the defendants allegedly sold garments that feature fabrics that bear plaintiff's designs.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, all profits, statutory damages, all legal fees, interest and any other relief as the court deems just. It is represented by C. Yong Jeong, Amy Choe and Ryan N. Ostrowski of Jeong & Likens LC in Los Angeles.
