Saguaro Palm Springs owes unpaid wages, former employee alleges

LOS ANGELES – A former employee for a Palm Springs hotel has filed a class-action suit over allegations of labor code violations.

Samantha Cornelius filed a complaint on behalf of others similarly situated on Feb. 21 in the U.S. District Court for the Central District of California against Joie De Vivre Hospitality LLC, Commune Hotels and Resorts LLC, Commune Services LLC, The Saguaro Palm Springs and Does 1 through 100 alleging violation of state labor codes and the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she was employed by the defendants as an office host from September 2015 to February 2016. The plaintiff holds Joie De Vivre Hospitality LLC, Commune Hotels and Resorts LLC, Commune Services LLC, The Saguaro Palm Springs and Does 1 through 100 responsible because the defendants allegedly failed to provide meal and rest breaks, did not provide accurate itemized wage statements, and did not pay all minimum and overtime wages.

The plaintiff requests a trial by jury and seeks compensatory damages, restitution, disgorged profits, enjoin the defendant, statutory and civil penalties, unpaid wages at 10 percent per annum, all legal fees, all unpaid wages and overtime compensation, liquidated damages and any other relief as the court deems just.
