Akeso Health Sciences accuses two entities of patent infringement

LOS ANGELES – A Westlake Village dietary supplement provider alleges two of its patents have been infringed.

Akeso Health Sciences LLC filed a complaint on Feb. 24 in the U.S. District Court for the Central District of California, Western Division against United Natural Foods West Inc. and United Natural Foods East Inc. alleging patent infringement.

According to the complaint, the plaintiff is the sole inventor and owner of patents numbers 6,068,999, titled Dietary Supplement for Supporting Cerebrovascular Tone and Treating Migraine Headaches, and 6,500,450, titled Composition for Treating Migraine Headaches. The suit states the plaintiff is the maker of MigreLief supplements.

The plaintiff holds United Natural Foods West Inc. and United Natural Foods East Inc. responsible because the defendants allegedly have directly infringed patents ‘999 and ’450 by making, using, selling, and/or offering to sell MigreLief products outside authorized categories of trade.

The plaintiff requests a trial by jury and seeks an order for defendants to pay plaintiff's actual damages, but no less than a reasonable royalty for the use made of plaintiff's patented inventions; award of three times the compensatory damages, attorney fees and costs; and such other just and proper relief.
