Konad Co. LTD alleges Moyou Nails, others infringed trademark

LOS ANGELES – The manufacturer of a stamping nail art kit alleges a direct competitor is selling nail products that incorporate its features.

Konad Co. LTD filed a complaint on March 3 in the U.S. District Court for the Central District of California against Ariel US LLC, doing business as Moyou Nails; Nir Algazy; Moshe Atkins; and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that only it and its licensees are authorized to create, market or distribute its stamping nail art products and that the defendants are not affiliated with the plaintiff. The plaintiff holds Ariel US LLC, doing business as Moyou Nails; Nir Algazy; Moshe Atkins; and Does 1-10 responsible because the defendant allegedly could cause confusion among consumers as to the true origin and affiliation of the infringing products.

The plaintiff requests a trial by jury and seeks judgment against defendants, enjoin them from further infringement, account and pay all profits realized by infringement, damages, and destroy remaining diluting products.
