Doctor alleges Anthem Blue Cross underpaid benefit claims

Insurance 05

LOS ANGELES – A medical doctor alleges an insurance provider has not adequately compensated her for services provided to patients.

Adel F. Samaan filed a complaint on March 3 in the U.S. District Court for the Central District of California, Western Division against Blue Cross of California, doing business as Anthem Blue Cross, and Does 1 to 100 alleging that the health plan provider violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has suffered damages for not receiving full payment for the health care services she has provided to ERISA Plan members administered and/or underwritten by the defendants. The plaintiff holds Blue Cross of California, doing business as Anthem Blue Cross, and Does 1 to 100 responsible because the defendant allegedly underpriced, undervalued, underpaid or entirely failed to pay the benefits claims submitted by plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages in an amount to be proven at trial, together with interest, attorney’s fees and costs. She is represented by Richard D. Williams and Lytton Hakakian of Lytton & Williams LLP in Los Angeles.
