LOS ANGELES –
The McClatchy Co.
is facing a class-action suit from a San Luis Obispo County individual over allegations it kept calling for a delinquent account that does not belong to him.
Wienold filed a complaint on behalf of all others similarly situated on
March 7 in the U.S. District Court for the Central District of
California against The McClatchy Co. alleging violation of the Telephone
Consumer Protection Act.
According to the complaint, the
plaintiff alleges that beginning in 2015, he suffered damages from
receiving several unwanted calls on his cellular telephone from the
defendant alleging he was delinquent on an account for the Merced
Sun-Star. He alleges he has never had a business relationship with the
defendant. The plaintiff holds The McClatchy Co. responsible because the
defendant allegedly kept calling him after he informed a representative
that he was not the party it was seeking and to stop calling him.
plaintiff requests a trial by jury and seeks $500 in statutory damages,
$1,500 in statutory damages, and any other relief as the court deems
