RS Construction alleged to owe unpaid contributions, failed to forward funds

LOS ANGELES – Labor union funds allege a contractor owes more than $300,000 in unpaid contributions.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on March 8 in the U.S. District Court for the Central District of California, Western Division against RS Construct Inc., also known as RS Construction; Randolph Robert Sall; Angela Marie Sall; Alexis Rae Sall; American Contractors Indemnity Co.; and Does 1 through 10 alleging failure to pay fringe benefit contributions and other counts.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions. The plaintiffs hold RS Construct Inc., also known as RS Construction; Randolph Robert Sall; Angela Marie Sall; Alexis Rae Sall; American Contractors Indemnity Co.; and Does 1 through 10 responsible because the defendants allegedly failed to forward the funds from their employees to the plaintiff for the vacation fund.

The plaintiffs seek unpaid contributions in the sum of $343,891.97, funds withheld from employees from the vacation plan in the sum of $94,725.52, unpaid contributions in the sum of $15,000 plus interest, all legal fees and any other relief as this court deems just. They are represented by Thomas Davis and Jodi Siegner of DeCarlo & Shanley in Los Angeles.
