LOS ANGELES — A furniture manufacturer is suing a California competitor, alleging copyright infringement and unfair competition.

Classic Concepts Inc. filed a complaint March 8 in U.S. District Court for the Central District of California against Muuduu Furniture and Phong Nguyen alleging they violated laws through unauthorized distribution of an intellectual property.

According to the complaint, Classic Concepts has sustained and will continue to sustain substantial monetary injury, loss and damage to its ownership rights in its copyrighted works, from Muuduu Furniture's wrongful conduct to attempt to sell home furnishings and merchandise that infringes upon the copyrights of the plaintiff. The suit says the defendant uses Classic Concepts' designs and photographic images, illegally copied from plaintiff's website, without any authority or consent from plaintiff.

The plaintiff alleges the defendants caused confusion among consumers as to the true origin and affiliation of the infringing product, obtained profit at the expense of plaintiff, and introduced an infringing product into the stream of commerce.

Classic Concepts seeks trial by jury, judgment for damages, a restraining order, injunctive relief, restitution, interest, exemplary damages, costs of suit, attorney fees and all further relief the court deems just. It is represented by attorney Paul S. Marks of Neufeld Marks APC in Los Angeles.
