eBay sellers accused of importing, selling counterfeit Beachbody products

LOS ANGELES – Beachbody alleges eBay sellers are offering counterfeit versions of its products.

Beachbody LLC filed a complaint on March 16 in the U.S. District Court for the Central District of California, Western Division against Power Trade Direct, Carl Encarnacion, Yadhira Duran, Beth Rivers and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation.

The plaintiff holds Power Trade Direct, Carl Encarnacion, Yadhira Duran, Beth Rivers and Does 1-10 responsible because the defendants allegedly imports counterfeit Beachbody exercise kits and DVDs from China to sell through eBay.

 

The plaintiff requests a trial by jury and seeks an award of damages and profits, actual damages, statutory damages, injunction against the defendants, restitution, treble damages, all legal fees, interest, and any other relief as the court deems just. It is represented by Christopher D. Johnson, Christopher Q. Pham and Marcus F. Chaney of Johnson & Pham LLP in Woodland Hills.
