Eveden Inc. alleges Color Image Apparel is unlawfully using Goddess mark

LOS ANGELES – The owner of a lingerie brand claims a Beverly Hills clothing company is unlawfully using its mark.

Eveden Inc. filed a complaint on March 17 in the U.S. District Court for the Central District of California against Color Image Apparel Inc. and Does 1 through 10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its trademark used. The plaintiff holds Color Image Apparel Inc. and Does 1 through 10 responsible because the defendants allegedly used the plaintiff's Goddess mark for women's bras and leggings and the plaintiff alleges it could cause confusion with its registered trademark.

The plaintiff requests a trial by jury and seeks enjoin the defendant, damages of at least $2.5 million, all legal fees, require the defendant to destroy all infringing materials, and any other relief as this court deems just.
