Everlast Builders Inc. alleged to owe more than $96,000 in employee contributions

LOS ANGELES – A California corporation is alleged to have not paid contributions to a labor union fund.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trust filed a complaint on March 17 in the U.S. District Court for the Central District of California, Western Division against Everlast Builders Inc., Vasilis Andrea Tsangarides and Does 1 through 10 citing the Labor-Management Relations Act and the Employee Retire Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions. The plaintiffs holds Everlast Builders Inc., Tsangarides and Does 1 through 10 responsible because the defendants allegedly breach their agreement with the labor group by failing to make monthly contribution on behalf of their employees and did not properly forward withheld funds to the vacation plan.

The plaintiffs seek unpaid contribution of $96,546.25, interest and liquidated damages, statutory damages, audit costs, withheld funds in the amount of $22,913.52, all legal fees, and any other relief as the court deems just. They are represented by Thomas Davis and Jodi Siegner of DeCarlo & Shanley in Los Angeles.
