Union funds allege Kahuna Construction Inc. owes unpaid contributions

LOS ANGELES – A construction company is alleged to owe more than $90,000 to labor union funds.

Carpenters Southwest Administrative Corp. and the board of trustees for the Carpenters Southwest Trusts filed a complaint on March 14 in the U.S. District Court for the Central District of California against Kahuna Construction Inc., also known as Kahuna Construction Inc.; Brian Keith Johns; and Does 1 through 10 citing the Employee Retirement Income Security Act and the Labor-Management Relations Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions from the defendants. The plaintiffs holds Kahuna Construction Inc., also known as Kahuna Construction Inc.; Johns; and Does 1 through 10 responsible because the defendants allegedly breached their contractual agreement with the plaintiff by failing to remit their monthly fringe benefit contributions on behalf of their employees and failed to forward withheld funds to the vacation plan.

The plaintiffs seek unpaid contributions of $94,621.49, interest, liquidated damages, withheld vacation plan in the amount of $16,307.63, injunction against the defendant, all legal fees and any other relief as the court deems just. They are represented by Jodi Siegner of DeCarlo & Shanley in Los Angeles.
