Woman alleges Elite Home Energy unlawfully contacted her for solicitation purposes

LOS ANGELES – A Huntington Beach consumer alleges that she was unlawfully called by a business to solicit its services and has filed a class action.

Denise Menichiello filed a complaint on behalf of all others similarly situated on March 16 in the U.S. District Court for the Central District of California against Elite Home Energy Inc. and Does 1 through 10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in January 2017, she suffered damages from receiving several unwanted calls on her home phone from the defendant. She alleges her number has been listed on the National Do-Not-Call Registry. The plaintiff holds Elite Home Energy Inc. and Does 1 through 10 responsible because the defendants allegedly contacted the plaintiff despite having no prior consent from her or a prior relationship.

The plaintiff requests a trial by jury and seeks statutory damages of $500, treble damages of $1,500 and any other relief as the court deems just. She is represented by Todd M. Friedman, Adrian R. Bacon and Meghan E. George of Law Offices of Todd M. Friedman PC in Woodland Hills, California.
