Man claims he is not the debtor Wells Fargo Fargo is trying to reach

SAN FRANCISCO – A Mississippi man alleges a San Francisco business keeps calling him for a debt that doesn't belong to him.

Elwood Jefferson filed a complaint on March 15 in the U.S. District Court for the Northern District of California against Wells Fargo Bank NA alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that he suffered damages from receiving several collection calls from the defendant seeking to collect an alleged debt, but he is not the debtor. The plaintiff holds Wells Fargo Bank NA responsible because the defendant allegedly kept on calling the plaintiff using an auto dialer despite his request to stop calling.

The plaintiff requests a trial by jury and seeks statutory damages of $500, treble damages, all legal fees and any other relief as the court deems just. He is represented by Trinette G. Kent, of counsel to Lemberg Law LLC in Wilton, Connecticut.
