SAN DIEGO – A San Diego County resident alleges a Florida company unlawfully called her to solicit a cruise vacation and has filed a class-action suit.

Roxanne Gonzalez filed a complaint on behalf of all others similarly situated on March 30 in the U.S. District Court for the Southern District of California against Grand Celebration Cruises LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in March, she suffered damages from being called on her cellular telephone by the defendant using a pre-recorded voice message. The plaintiff holds Grand Celebration Cruises LLC responsible because the defendant allegedly called the plaintiff without her prior express consent.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, injunctive relief, $1,500 in treble damages, all legal fees and any other relief as the court deems just. She is represented by Kevin Lemieux of Hyde & Swigart in San Diego and by Abbas Kazerounian of Kazerouni Law Group in Costa Mesa.
