SAN DIEGO – A Del Mar corporation has filed suit against the owners of several department stores over allegations it sells infringing suitcases.

Nuki Inc. filed a complaint on March 29 in the U.S. District Court for the Southern District of California against Marshalls of CA LLC, Marshalls of MA Inc., The TJX Cos. Inc. and Does 1-10 alleging patent infringement.

According to the complaint, the plaintiff alleges that Nuki Inc. sells luggage and has developed a patent for a front-opening, hard-shell suitcase. The plaintiff holds Marshalls of CA LLC, Marshalls of MA Inc., The TJX Cos. Inc. and Does 1-10 responsible because the defendants allegedly sells hard shell suitcases that infringes plaintiff's patent.

The plaintiff requests a trial by jury and seeks permanent injunction, award profits to the plaintiff, all damages, treble damages, all legal fees and any other relief as the court deems just. It is represented by Trevor Q. Coddington and James V. Fazio III of San Diego IP Law Group LLP in San Diego.
