LOS ANGELES – A Commerce company is accused of manufacturing or distributing garments with an infringing fabric design.

Kilina America Inc. filed a complaint on March 30 in the U.S. District Court for the Central District of California against Cornerstone Apparel Inc., doing business as Papaya Clothing, alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Cornerstone Apparel Inc. and Does 1-10 responsible because the defendants allegedly sold garments made out of fabrics that bear plaintiff's KSP-54387 design without authorization.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, award all profits to the plaintiff, statutory damages, interest, all legal fees, and any other relief as the court deems just. It is represented by C. Yong Jeong and Amy J. Choe of Jeong & Likens LC in Los Angeles.
