SAN DIEGO – A San Diego County business entity alleges the motor home it purchased is defective.
General Hemp LLC filed a complaint on April 5 in the U.S. District Court for the Southern District of California against the Thor Motor Coach Inc., Ford Motor Co., Lippert Components Inc., RV Solutions Inc. and Does 1-10 alleging that they violated the Song-Beverly Consumer Warranty Act.
According to the complaint, the plaintiff alleges that in Aug. 29, 2014, plaintiff purchased a new 2014 Thor Hurricane from defendant RV Solutions. When delivered, he alleges experienced serious defects and nonconformities with the motor home and that the defects substantially impaired its use, value and safety. The plaintiff holds Thor Motor Coach Inc. Ford Motor Co., Lippert Components Inc., RV Solutions Inc. and Does 1-10 responsible because the defendants allegedly failed to repair the motor home to conform to the warranties and failed to refund plaintiff's purchase price.
The plaintiff seeks rescission of the purchase contract, general damages, interest, reasonable attorneys’ fees, costs of suit and such other and further relief as the court deems just and proper.
