Individual alleged to have shook child while the child was in her care

SAN DIEGO – A San Diego County caretaker is alleged to have injured a minor child.

K.C., a minor, by and through her guardian ad litem Vanessa Huckaba, filed a complaint on April 5 in the U.S. District Court for the Southern District of California against Melanie Vejmola, LHM Holdings LLC, Lincoln Property Co., et al alleging negligence and battery.

According to the complaint, on Oct. 11, 2015, Huckaba claims that while at the care of child care program of defendant Vejmola, K.C. was injured because Vejmola shook the child.  The plaintiffs holds Vejmola, LHM Holdings LLC, Lincoln Property Co., et al responsible because the defendants allegedly failed to implement and/or enforce any policies or procedures aimed to prevent the unlicensed operation of child care in the residences, subjecting minor children to abuse and inadequate care and supervision.

The plaintiffs request a trial by jury and seeks judgment for general and economic damages, medical-related expenses, costs of suit, prejudgment interest and such other further relief as the court deems just and proper. They are represented by Philip C. Alexander and Ryan D. Harris of Harris Personal Injury Lawyers Inc. in Oceanside.
