Sovereign Surgical Holdings claims Dual Diagnosis Treatment Center is causing confusion with use of trademark

LOS ANGELES – A health care company is suing a medical rehabilitation center operator over allegations it is unlawfully using a trademark.

Sovereign Surgical Holdings LP filed a complaint on April 3 in the U.S. District Court for the Central District of California against Dual Diagnosis Treatment Center Inc. alleging trademark infringement, unfair business practices and other counts.

According to the complaint, the plaintiff alleges that its Sovereign Health Mark was used by the defendant for conducting and promoting its business and services by displaying the plaintiff's trademark on its website, building, signage, billboards and radio advertisements. As a result, the plaintiff alleges the use of the Sovereign Health Mark caused actual confusion to the public, damaged of reputation and loss of income. 

The plaintiff requests a trial by jury and seeks award for damages, reasonable attorneys' fees, pre- and post-judgment interest and such further relief as the court shall deem just and proper. It is represented by Michael Adams of Rutan and Tucker LLC in Costa Mesa.
