SAN FRANCISCO – A driver alleges a trucking company unlawfully misclassified its drivers as independent contractors and owes employees unpaid wages.

Thomas Huddleston filed a complaint on behalf of all others similarly situated on April 13 in the U.S. District Court for the Northern District of California against John Christner Trucking LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid minimum or overtime wages. The plaintiff holds John Christner Truckin, LLC responsible because the defendant allegedly failed to pay the plaintiff overtime premium for working more than 40 hours, did not provide accurate wage statements and failed to provide meal and rest periods.

The plaintiff seeks damages, restitution, all unpaid wages, injunctive relief, compensatory damages, liquidated damages, actual damages, punitive damages, interest, all legal fees and any other relief as the court deems just.
