Bluff City Laboratory Services alleged to have failed to pay XIFIN for services

SAN DIEGO – A San Diego health information technology company alleges a Tennessee company failed to pay for services provided.

XIFIN Inc. filed a complaint on April 12 in the U.S. District Court for the Southern District of California against Bluff City Laboratory Services alleging breach of contract.

According to the complaint, the plaintiff alleges that on June 29, 2015, it and the defendant entered into a written Revenue Performance Management system (RPM) wherein plaintiff would provide cloud-based laboratory diagnostic billing services. XIFIN claims it as performed all material in terms of the contract of 36 months but failed to receive payment in the amount of $60,623.08. 

The plaintiff holds Bluff City Laboratory Services responsible because the defendant allegedly failed and continues to fail to pay amounts due and owing under the contract amounting to $133,173.84 in unpaid services fee, as well as accelerated monthly minimum service fees of $360,000.

The plaintiff seeks judgment for damages in the amount of $493,173.84, prejudgment interest, costs of suit and such other relief as the court deems just and proper. It is represented by John D. Hershberger and Christopher Beal of Dillon Gerardi Hershberger Miller and Ahuja LLP in Carlsbad.
