Man alleges Swissport USA did not provide meal and rest breaks

SAN FRANCISCO – A San Mateo man alleges his ground and cargo handling service employer violated labor codes.

Fesaitu Mario filed a complaint on behalf of all others similarly situated on April 14 in the U.S. District Court for the Northern District of California against Swissport USA Inc., Swissport Cargo Services LP citing the Fair Labor Standards Act and California labor codes.

According to the complaint, the plaintiff has been employed by the defendants since 2015 at the San Francisco airport and alleges he has worked for more than 40 hours a week without being paid any overtime wages. The plaintiff holds Swissport USA Inc., Swissport Cargo Services LP responsible because the defendants allegedly failed to pay proper wages to the plaintiff, failed to provide rest breaks and did not provide accurate wage statements.

The plaintiff requests a trial by jury and seeks nominal damages, disgorgement, interest, all legal fees and any other relief as the court deems just. He is represented by Marcus J. Bradley, Kiley L. Grombacher and Taylor L. Emerson of Bradley/ Grombacher LLP in Westlake Village.
