Klauber Bros. claims Hot Topic sells garments with infringing lace design

LOS ANGELES – An Industry retail chain is accused of copying a lace design without authorization.

Klauber Bros. Inc. filed a complaint on April 14 in the U.S. District Court for the Central District of California against Hot Topic Inc. and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that due to defendants’ infringing acts, it has suffered and will continue to suffer substantial damages to its business in an amount to be established at trial.

The plaintiff holds Hot Topic Inc. and Does 1-10 responsible because the defendants allegedly manufactured and/or supplied garments bearing lace manufactured with plaintiff’s copyrighted designs without plaintiff’s knowledge or consent.

The plaintiff requests a trial by jury and seeks monetary advantage gained by defendants through their infringement, statutory damages, attorneys’ fees, costs of the action and such further legal and equitable relief as the court deems proper. It is represented by Stephen M. Doniger, Scott Alan Burroughs, Trevor W. Barrett and Justin M. Gomes of Diniger/Burroughs in Venice.
