Cushman & Wakefield of California Inc. accused of concealment

SAN FRANCISCO – A San Francisco partnership is accusing a commercial real estate broker of fraudulent concealment regarding the sale of a Richmond apartment complex.

Menlo Westridge Affordable Partners LP filed a complaint on March 29 in the San Francisco County Superior Court against Cushman & Wakefield of California Inc. and Does 1 through 10 alleging fraudulent and negligent concealment.

According to the complaint, the plaintiff alleges that it suffered damages from purchasing a property that is deficient in seismic quality. The plaintiff holds Cushman & Wakefield of California, Inc., and Does 1 through 10 responsible because the defendants allegedly concealed that the property was located in a fault zone

The plaintiff seeks compensatory damages, punitive damages, all legal fees and any other relief as the court deems just. It is represented by Patrick P. Gunn and Charles M. Schaible of Cooley LLP in San Francisco.
