1734 Lombard Street Owners' Association claims units have construction defects

SAN FRANCISCO – An owners association for eight condos and one commercial unit allege the properties have defects.

1734 Lombard Street Owners' Association filed a complaint on April 3 in the San Francisco County Superior Court against Lombard Bay Associates LLC, Robert Mellett and Does 1-100 alleging strict products liability, breach of implied warranty, negligence and other counts.

According to the complaint, the defendants mass produced and/or distributed homes and sold them to the public. The plaintiff alleges its members purchased units from the defendants. The plaintiff holds Lombard Bay Associates LLC, Mellett and Does 1-100 responsible because the defendants allegedly constructed a defective property and that its members will have to pay for restoration and repairs.

The plaintiff seeks compensatory damages, interest, all legal fees, professional fees, and any other relief as this court deems just. They are represented by Kevin D. Frederick and Paul K. Lee of Law Offices of Kevin D. Frederick in Redwood City.
