Tenants allege former landlords unlawfully terminated lease, did not fix water issues

SAN FRANCISCO – Two San Francisco individuals alleged their former landlords failed to fix water issues with a rental property.

Bethany Ehrhart and Alexandra Osmidoff filed a complaint on April 3 in the San Francisco County Superior Court against Anna Y. S. Chung, May May Chung, Peter Ming Wah Chung and Does 1 to 10 alleging breach of warranty and negligence.

According to the complaint, the plaintiffs leased a 46th Avenue property from the defendants and allege the property has leaking windows, water intrusions and microbial growth. The plaintiffs holds Anna Y. S. Chung, May May Chung, Peter Ming Wah Chung and Does 1 to 10 responsible because the defendants allegedly failed to remediate these issues and also unlawfully terminated the plaintiffs' lease in April 2016.

The plaintiffs request a trial by jury and seek general damages, special damages, contractual damages, all legal fees, statutory damages, punitive damages and any other relief as the court deems just. They are represented by Tom H. Elke and Alexander M. Merchant of Elke & Merchant LLP in San Francisco.
