SAN FRANCISCO – A San Joaquin County consumer claims he purchased a vehicle that later developed defects in the transmission.

Mark Tabaldi filed a complaint on April 3 in the San Francisco County Superior Court against General Motors LLC and Does 1 through 10 alleging breach of express warranty.

According to the complaint, the plaintiff alleges that he purchased a 2012 Chevrolet Equinox in 2012 that came with a warranty. He alleges that while the warranty was in effect, the transmission developed defects. The plaintiff holds General Motors LLC and Does 1 through 10 responsible because the defendants allegedly failed to fix the defects of the plaintiff's vehicle, including excessive oil consumption and defects to its powertrain, to bring it into conformity with the warranty.

The plaintiff requests a trial by jury and seeks actual damages, restitution, consequential and incidental damages, all legal fees, punitive damages, interest and any other relief as this court deems just.
