SAN FRANCISCO – A former sales manager for Shadow Ridge Marriott Vacations Worldwide Corp. alleges her claim for long-term disability benefits was unlawfully denied.

Holly Kmita filed a complaint on April 27 in the U.S. District Court for the Northern District of California against Aetna Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled in 2016 and applied for disability benefits. The suit states that the defendant approved short-term disability benefits but denied long-term. The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly denied plaintiff's long-term disability benefits despite being disabled according to the policy.

The plaintiff seeks compensatory damages, all legal fees, interest and any other relief as the court deems just. She is represented by P. Randall Noah of Law Offices of P. Randall Noah in Orinda.
