Senior couple accuses family member of elder financial abuse

SAN FRANCISCO – A senior couple are accusing a relative of fraud and elder abuse.

Nellie Bertucci and Robert Bertucci filed a complaint on April 5 in the San Francisco County Superior Court against Angelique Tavares and Does 1 to 50 alleging elder financial abuse, fraud and other counts.

According to the complaint, the plaintiffs are older than 65 and the defendant is Nellie Bertucci's daughter. The suit states the plaintiffs have a brokerage account and real property in San Francisco and that in April 2016, the defendant convinced her to name the defendant as power of attorney. The plaintiffs hold Tavares and all other defendants responsible because Tavares allegedly convinced Nellie Bertucci to transfer more than $1.5 million and transfer her interest in the real property to the defendant and refused to return the property.

The plaintiffs seek general, special, consequential and incidental damages; injunction against the defendants; exemplary and punitive damages; interest; all legal fees and any other relief as the court deems just. They are represented by Robert R. Moore and Michael J. Betz of Allen Matkins Leck Gamble Mallory & Natsis LLP in San Francisco.
