First and Mission Properties accuses Tohigh Property Investment, others of trespass

SAN FRANCISCO – A property owner alleges its roof was used without permission.

First and Mission Properties LLC filed a complaint on April 4 in the San Francisco County Superior Court against Tohigh Property Investment LLC, Oceanwide Center LLC, Silverado Contractors Inc. and Does 1-20 alleging trespass, private nuisance and injunctive relief.

According to the complaint, Tohigh and Oceanwide own and/or control a property at 78 First St., San Francisco and that Silverado was hired to demolish this property. The suit states the plaintiff owns an adjacent property and that defendants wished to use the plaintiff's roof as a staging area. The plaintiff alleges it would not permit the use of the roof without a license and indemnity agreement. The plaintiff holds Tohigh Property Investment LLC, Oceanwide Center LLC, Silverado Contractors Inc. and Does 1-20 responsible because the defendants allegedly entered plaintiff's property and installed scaffolding on the plaintiff's roof in April without permission.

The plaintiff seeks order the defendants to remove the scaffolding they installed, prohibit the defendant from entering the roof, general damages, special damages, exemplary and punitive damages, all legal fees, and any other relief as the court deems just.
