Daughter files suit against California Armenian Home alleging malpractice, wrongful death

FRESNO – The daughter of a former resident of a nonprofit Fresno nursing facility has filed a wrongful death suit.

Ralph Tomasian, deceased by and through his successor in interest/heir to Virginia Tomasian, filed a complaint on April 21 in the Fresno County Superior Court against California Home for the Aged Inc. doing business as California Armenian Home; Carey Tomasian; Jan Silvera; and Does 1 through 100 citing medical malpractice, negligence/willful misconduct, wrongful death, elder abuse and violations of residents' rights.

According to the complaint, Ralph Tomasian was admitted to the California Armenian Home for care and assistance with all activities of daily living on Jan. 5 at the age of 98. His daughter, plaintiff Virginia Tomasian, claims that during her father's stay at the facility, his condition continued to decline and that he was only given aspirin for his symptoms of chronic constipation. On Feb. 13, the suit states Ralph Tomasian was transported by ambulance and was later diagnosed with an unrelieved fist-sized blockage of the colon. He died the next day due to severe bowel impaction, rectal perforation and related infection. 

Virginia Tomasian alleges the defendants failed to provide the deceased with the care, monitoring and treatment required for his chronic constipation, consciously chose to disregard the many signs and symptoms he showed.

The plaintiff seeks judgment for compensatory and special damages, costs of litigation, attorney's fees, costs of suit incurred, and for all other relief that the court deems just and proper. She is represented by Mark A. Redmond of Law Offices of Mark A. Redmond PC in Sacramento.
