Bank of the West alleges it is owed more than $60,000 on equipment agreement

SAN FRANCISCO – A financial institution alleges a New Mexico man has failed to make payments on an equipment agreement.

Bank of the West filed a complaint on April 19 in the San Francisco County Superior Court against Eliberto Bordayo, also known as Eliberto Bordayo Jr., an individual doing business as Bordayo Trucking; and Does 1 through 20 alleging breach of financial agreement.

According to the complaint, the plaintiff alleges that it and Bordayo entered into an equipment financing agreement in 2015. The plaintiff holds Bordayo and Does 1 through 20 responsible because the defendants allegedly breached their contractual agreement with the plaintiff by failing to make their monthly payment.

The plaintiff seeks the sum of $65,118.65 plus interest, other damages, all legal fees and any other relief as the court deems just. It represented by Mark M. Scott of Buchalter in Irvine.
