Mercy San Juan Medical alleged to have discriminated against transgender man

SAN FRANCISCO – A transgender man residing in Orangevale alleges that a hospital refused to provide medical services to him because of his gender identity.

Evan Minton filed a complaint on April 19 in the San Francisco County Superior Court against Dignity Health and Dignity Health, doing business as Mercy San Juan Medical, Center alleging violation of the Unruh Civil Rights Act.

According to the complaint, the plaintiff alleges that he was diagnosed with gender dysphoria and was scheduled for a hysterectomy in August 2016. He alleges that the defendants' personnel were notified in conversation that the plaintiff is transgender and that the next day the surgery was canceled.

The plaintiff holds Dignity Health and Dignity Health, doing business as Mercy San Juan Medical Center, responsible because the defendant allegedly discriminated against the plaintiff because of his diagnosis of gender dysphoria.

The plaintiff seeks statutory damages of $4,000, to enjoin the defendants from discriminating on the basis of gender identity, all legal fees, interest and any other relief as the court deems just. He is represented by Christine Saunders Haskett of Covington & Burling LLP in San Francisco.
