Consumer claims Select Portfolio Servicing, Ocwen Loan Servicing violated state Homeowner Bill of Rights

FRESNO – A Fresno consumer is accusing two entities of bad faith loan modification practices.

Jill Russo filed a complaint on April 28 in the Fresno County Superior Court against Select Portfolio Servicing Inc., Ocwen Loan Servicing LLC and Does 1-10 alleging that they violated the California Homeowner Bill of Rights.

According to the complaint, the plaintiff alleges that she applied for a loan modification review with the defendants and was told that while her application was reviewed to not make mortgage payments. The suit states her loan was put in foreclosure and that she was never informed if her review was closed or denied.

The plaintiff holds Select Portfolio Servicing Inc., Ocwen Loan Servicing LLC and Does 1-10 responsible because the defendants allegedly intentionally, maliciously and egregiously took undue and fraudulent advantage of the plaintiff.

The plaintiff seeks actual and compensatory damages plus penalties under the California Homeowner Bill of Rights, attorney's fees and costs and all other relief as the court may deem proper and equitable. She is represented by Matin Rajabov and Hayk M. Grigoryan of Olympia Law Group in Los Angeles.
