Individual alleges trusts' properties were taken without legal owner's consent

FRESNO – An individual is seeking an action to terminate three trusts.

Oscar Luna filed a complaint on May 1 in the Fresno County Superior Court against the estate of Jean Michel Irigoyen, Calfed Law Corp., J.M. Irigoyen Law Corp. and Laura Kuhne Irigoyen, personally and as administrator of the estate of Jean Michel Irigoyen, seeking declaratory relief.

According to the complaint, the plaintiff alleges that pursuant to an agreement, plaintiff and Jean Michel Irigoyen agreed to trusts that would be terminable when paid in full, at plaintiff's death, or at defendant J.M. Irigoyen's legal incompetency or bankruptcy, whichever first occurred. Plaintiff claims that he became the legal owner with exclusive right to possess the properties when the defendant became legally incompetent as agreed in the contract. 

The plaintiff holds the estate of Jean Michel Irigoyen, Calfed Law Corp., J.M. Irigoyen Law Corp. and Kuhne Irigoyen, personally and as administrator of the estate of Jean Michel Irigoyen, responsible because the defendants allegedly wrongfully took possession of the trusts' properties without legal owner's consent and refused to surrender trust properties to the legal owner.

The plaintiff seeks an order declaring plaintiff as the sole true and lawful owner of the trust properties, an order requiring to surrender the delivery the trust properties, costs of suit, interest at the legal rate, and all other relief the court deems just and proper. The plaintiff is representing himself.
