FRESNO – The city of Fresno alleges that a property is not in compliance and that its owners have failed to take corrective action.

City of Fresno and people of the state of California filed a complaint on May 9 in the Fresno County Superior Court against Avita Gaspar and Does 1-50 alleging that they violated Fresno Municipal Codes.

According to the complaint, the defendants own a single family residence that has been cited for municipal code violations multiple times. Recently, the city inspected the property and found alternations done without the required permits, missing carbon monoxide detectors and other issues.

The plaintiffs hold Gaspar and Does 1-50 responsible because the defendants allegedly have not taken steps to correct the violations.

The plaintiffs seek permanent injunction enjoining defendants from maintaining the violations of the Fresno Municipal Code, an order for defendants to pay any and all administrative citations issued to them, award for costs of suit and to appoint a receiver for the property to correct conditions and/or to sell or demolish the property and such other relief as the court deems proper. They are represented by Douglas T. Sloan and Chad T. Snyder of the city of Fresno.
