Former Union Pacific Railroad employee alleges he was damaged by exposure to toxic substances

OAKLAND – A Texas man alleges he developed cancer as a result of exposure to carcinogens during his employment at an Oakland facility.

Michael Krengloskie filed a complaint on May 31 in the U.S. District Court for the Northern District of California against Union Pacific Railroad Co. citing the Federal Employers' Liability Act and the Locomotive Inspection Act.

According to the complaint, the plaintiff was employed at the defendant's Oakland yard as a fireman and oiler/carman from 1979 to 2012. He alleges that he suffered physical injuries from having developed kidney cancer as the result of being exposed to toxic substances such as chemicals, solvents, benzene and others during his employment.

The plaintiff holds Union Pacific Railroad Co. responsible because the defendant allegedly failed to provide proper safety equipment and failed to use ordinary care and caution to provide the plaintiff with a safe place to work.

The plaintiff requests a trial by jury and seeks the sum of $150,000 and all legal fees. He is represented by Dale Ratner of Marc J. Bern & Partners in San Francisco.
