Two insurance companies have failed to pay life insurance benefits, Fresno County man claims

Late 06

FRESNO – A Fresno County man alleges his claim for life insurance benefits has not been paid.

Homer Harris filed a complaint on May 12 in the Fresno County Superior Court against Athene Annuity and Life Insurance Co. and Protective Life Insurance Co. and Does 1-50 alleging breach of contractual duty to pay covered claim and other counts.

According to the complaint, the plaintiff alleges that in 2016 after the death of his wife, the plaintiff submitted a claim for insurance benefits under a policy issued by defendants. The plaintiff alleges he has not received any further communications and has not been paid the benefits he is due under the policy.

The plaintiff holds Athene Annuity and Life Insurance Co. and Protective Life Insurance Co. and Does 1-50 responsible because the defendants allegedly failed to respond to plaintiff's attorney’s letter and failed to pay any benefits due under the policy.

The plaintiff requests a trial by jury and seeks all damages in a sum according to proof, attorneys’ fees and costs and such other relief the court deems proper. He is represented by George J. Vasquez of George J. Vasquez PLC in Fresno.
