SACRAMENTO – A former sales employee alleges that a Georgia-based company doing business in California failed to provide paid sick leave.

Carl Stearne filed a complaint on behalf of all other aggrieved employees on June 6 in the U.S. District Court for the Eastern District of California against Heartland Payment Systems LLC and Global Payments Inc. citing the Private Attorney General Act.

According to the complaint, the plaintiff worked for the defendants a sales person from February to May 2016. The plaintiff alleges that the defendants allegedly refused to provide paid sick leave to the plaintiff.

The plaintiff requests a trial by jury and seeks declaration that the defendants have violated the labor code, interest, all legal fees and any other relief as the court deems just. He is represented by Richard A. Hoyer and Ryan L. Hicks of Hoyer & Hicks in San Francisco and by Walter Haines of United Employees Law Group in Huntington Beach.
