Farmers Insurance Exchange seeks more than $100,000 from motorist

FRESNO – An insurance company is seeking damages from a motorist after a collision in Fresno County.

Farmers Insurance Exchange filed a complaint for damages and uninsured motorist bodily injury subrogation on May 12 in the Fresno County Superior Court against Matthew Rogers and Does 1 through 5, inclusive.

According to the complaint, the plaintiff alleges that in Sept. 5, 2015, its insured Peryna Washington was struck by the defendant on SF-41 north of Central Avenue in Fresno County. The suit states that as a result, plaintiff the insured property was damaged in the total sum of $8,850.43 and the insurance owner/driver and passengers were injured. Plaintiff allegedly paid for the injuries the total sum of $100,000 pursuant to the uninsured motorist provisions of the policy. 

The plaintiff holds Rogers and Does 1 through 5, inclusive responsible because the defendants allegedly failed to pay insurance company the full amount of the damages sustained by its insured.

The plaintiff requests a trial by jury and seeks payment for damages in the sum of $108,850.43, plus costs of suit, interest at the legal rate from Sept. 5, 2015 and Jan. 25, 2016, and for such other and further relief as the court deems just and proper.
