Poncho & Goldstein Inc. accused of infringing design for Wine Eye Chart product

LOS ANGELES – A Santa Barbara County artist that designed the "Wino Eye Chart" alleges his artwork was unlawfully copied.

Jan Davidson and Laugh Lines filed a complaint on June 8 in the U.S. District Court for the Central District of California, Western Division against Poncho & Goldstein Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiffs allege that Jan Davidson and Laugh Lines suffered damages from having their copyrighted product infringed. The plaintiffs hold Poncho & Goldstein Inc., and Does 1 through 10 responsible because the defendants allegedly used elements of the plaintiffs' "Wino Eye Chart" for its Wine Eye Chart product.

The plaintiffs request a trial by jury and seek statutory damages in the amount of $150,000, profits and compensatory damages, punitive and exemplary damages, interest, all legal fees and any other relief as the court deems just. They are represented by Frank Frisenda Jr. of Frisenda, Quinton & Nicholson in Los Angeles.
