Ferguson Enterprises Inc. alleges it is owed more than $27,000 for plumbing supplies

LOS ANGELES – A Virginia corporation authorized to do business in the state alleges that it was not paid for supplies provided for a federal project.

United States for the use and benefit of Ferguson Enterprises Inc. filed a complaint on June 12 in the U.S. District Court for the Northern District of California against McCullough Plumbing Inc., The Guarantee Co. of North America USA, Halbert Construction Co. Inc. and The Western Surety Co. citing the Miller Act.

According to the complaint, Halbert was contracted by the U.S. for construction work on the Monterey Dining Facility for the Navy, and McCullough was subcontracted for plumbing installation. The suit states McCullough asked Ferguson to furnish certain plumbing supplies and the plaintiff alleges that it has not been reimbursed for these supplies.

The plaintiffs seek principal amount of $27,635.04 plus interest, all legal fees and any other relief as the court deems just. They are represented by Michael I. Wayne of Law Offices of Michael I. Wayne, APC in Los Angeles.
