Former employee alleges Turner Contracting Inc. violated state labor codes

SAN FRANCISCO – A San Jose man alleges that his former Indiana-based employer failed to adequately pay him for all hours worked.

James Outley II filed a complaint on behalf of all others similarly situated on June 14 in the U.S. District Court for the Northern District of California against Turner Contracting Inc. alleging violation of labor codes.

According to the complaint, the plaintiff alleges that he employed by the defendant in Cupertino from May 2016 to January 2017. The plaintiff holds Turner Contracting Inc. responsible because the defendant allegedly failed to pay minimum wages for work performed off-the-clock or overtime wages, failed to provide meal and rest breaks, failed to provide proper wage statements and other counts.

The plaintiff requests a trial by jury and seeks nominal damages, disgorgement of profits, interest, all legal fees and any other relief as the court deems just. He is represented by Marcus J. Bradley, Kiley L. Grombacher and Taylor L. Emerson of Bradley Grombacher LLP in Westlake Village.
