Former field engineer for EOS companies alleges he was not paid overtime

SAN FRANCISCO – A Santa Clara County man alleges that he was misclassified as exempt from overtime pay.

Mike Nguyen filed a complaint on behalf of all others similarly situated on June 22 in the U.S. District Court for the Northern District of California against EOS IT Management Solutions Inc. and EOS Unified Solutions Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants as a field engineer from May 2015 to June 2016. The plaintiff holds EOS IT Management Solutions Inc. and EOS Unified Solutions Inc. responsible because the defendants allegedly failed to pay minimum wages, failed to pay for overtime work at a rate of time-and-one-half and failed to provide adequate meal and rest breaks.

The plaintiff seeks liquidated damages, restitution and/or statutory penalties, all legal fees and any other relief as the court deems just. He is represented by Lorrie T. Peeters of Caffarelli & Associates LTD in Cupertino.
