Credit One Bank accused of robocalling incorrect number

FRESNO – A Terra Bella woman alleges that a financial institution has called her for four years and has the wrong number.

Yolanda Almanza filed a complaint on June 21 in the U.S. District Court for the Eastern District of California, Fresno Division against Credit One Bank NA and John Does 1-25 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she suffered damages from being contacted several times on her cellular telephone from the defendants in their attempt to reach a person only identified as Peter. She alleges the calls are made using an automatic dialing machine.

The plaintiff holds Credit One Bank NA and John Does 1-25 responsible because the defendants allegedly called the plaintiff's cellular telephone without her consent and continued to call despite her informing them that they were calling the wrong party and to stop calling.

The plaintiff requests a trial by jury and seeks statutory damages of $500, enhanced treble damages of $1,500, and any other relief as the court deems just. She is represented by Jonathan A. Stieglitz of The Law Offices of Jonathan A. Stieglitz in Los Angeles.
